This month, we had 74 cases on the Board of Trustees' agenda, with 47 members approved for Accident Disability Retirement or Line of Duty Death benefits.
Of those approvals, 27 were approved under the WTC Bill. After months of back-and-forth with the Police Commissioner's representative on the board regarding implementation of the new WTC Verification Presumptive Bill, we have come to an understanding where the City-side Trustees are putting a statement on the record and allowing these cases to go to a vote for approval, without unnecessary delays. CEA President Chris Monahan deserves recognition for pushing that legislation through, and for seeing that its implementation is consistent with the spirit of the law. We are in the process of refiling applications previously denied by the Board of Trustees for verification, and hope to have all those cases approved by the end of the year.
We had several approvals under the Heart Bill this month, along with two unfortunate cases where members would have qualified, but failed to file applications at the Medical Division prior to their retirement. GML 207-k provides a presumption that certain disabling conditions of the heart qualify for Accident Disability Retirement. Heart Bill applications must be filed while still in City service, and will not be accepted after retirement. It is absolutely essential that members undergo all the recommended screening prior to retirement, and when in doubt, file an application before coming off the books.
We are Disability Counsel to the NYPD Captains Endowment Association, Lieutenants Benevolent Association, Sergeants Benevolent Association and Detectives' Endowment Association. We strongly encourage active and retired members to reach out to us if they have questions about filing an application for disability retirement, and to do so early in the process. We also represent members filing September 11th Victim Compensation Fund claims and for Social Security Disability Insurance benefits.
