A Message from the LBA Disability Attorneys

In the wake of Hurricane Sandy, we would like to take a moment to acknowledge the heroic efforts by members of service who are placing themselves in harms way on behalf of the safety of the public. We also wish to remind members of the importance of taking the time to properly detail the accidental nature of any line of duty injuries suffered pursuant to rescue and recovery efforts.
Given the exigent nature of this catastrophe, members may not have had an adequate opportunity to properly record the accidental nature of their injuries as required for Accident Disability Retirement purposes. These reports will likely receive great scrutiny years from now and hastily prepared reports may result in denials down the road.
While reports need to be filed in a timely manner, they should not be hurriedly prepared. Furthermore, contemporaneous medical evidence and amendments (so long as they are filed within days and weeks of injury) are given significant weight and consideration in the Accident Disability application process.
We encourage all members to review and prepare such records with the advice of counsel to insure that they are completed properly.
Particularly in these difficult times, no member should be denied their entitlement to an Accident Disability Retirement because their attention was focused on the situation at hand, and not towards their own needs or protection. We remind members that as your union disability attorneys we are available to assist you with the preparation of these reports.
